These Terms and Conditions ("Terms") govern your access to and use of this website (the "Website") and the purchase of products from Art Bathrooms ("we", "us", "our").

By accessing this Website or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use this Website.

2. Eligibility

You must be at least 18 years old or have the permission of a parent or legal guardian to use this Website and place an order.


3. Products & Availability

All products are subject to availability.

We reserve the right to discontinue, modify, or limit products at any time without notice.

Product images are for illustrative purposes only. Variations in colour, finish, grain, texture or size may occur due to lighting, manufacturing processes, and screen displays.


4. Pricing & Currency

Prices are displayed in Australian Dollars (AUD), unless New Zealand Dollars (NZD) is selected at checkout.

Australian Orders:
Prices include GST where applicable.

New Zealand Orders:
Prices do not include New Zealand GST, customs duties, import taxes, biosecurity fees, or clearance charges unless explicitly stated. These charges are the responsibility of the customer and may be payable upon delivery.

Shipping costs are calculated at checkout.

We reserve the right to change prices at any time prior to order acceptance.


5. Orders & Acceptance

Placing an order constitutes an offer to purchase.

Orders are not accepted until you receive a confirmation email from us.

We reserve the right to refuse or cancel orders for any reason including stock availability, pricing errors, suspected fraud, or shipping limitations.

If an order is cancelled after payment has been processed and prior to shipment, a refund will be issued.


6. Payment

Payment must be made in full at the time of purchase.

We accept the payment methods displayed at checkout.

All transactions are securely processed via third-party payment providers. We do not store full payment details.


7. Shipping & Delivery

Australia

We ship Australia-wide.

Delivery timeframes are estimates only and are not guaranteed.

Risk of loss or damage passes to you upon delivery.

New Zealand

Selected products may be shipped to New Zealand.

Delivery timeframes are estimates only and may be affected by customs clearance, inspections, or biosecurity procedures.

You are responsible for:

  • Customs duties
  • Import GST
  • Clearance fees
  • Biosecurity charges
  • Any other government-imposed costs

We are not responsible for delays caused by customs, regulatory processes, or border inspections.

If a shipment is refused, returned, or abandoned due to unpaid duties, incorrect information provided by the customer, or failure to comply with import requirements, all return freight, storage, and administrative costs will be deducted from any applicable refund.


Bulky & Heavy Goods

Some products are classified as bulky or heavy items.

It is the customer’s responsibility to:

  • Ensure safe and reasonable access to the delivery address
  • Arrange sufficient assistance to unload items if required

We are not responsible for failed deliveries due to site access issues.


Freight Damage

All deliveries must be inspected immediately upon receipt.

If visible freight damage is present:

  • It must be noted with the carrier at the time of delivery
  • Photographs must be taken
  • We must be notified within 48 hours

Failure to report freight damage within this timeframe may affect your ability to make a claim.


8. Returns, Refunds & Exchanges

Australian Consumer Law

For Australian customers, our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.


New Zealand Consumer Protections

For New Zealand customers, rights available under applicable New Zealand consumer protection laws apply where relevant.


 

Change of Mind

We do not offer refunds for change of mind unless expressly stated.

If a change of mind return is approved:

  • Items must be unused, uninstalled, and in original packaging
  • Return freight is the customer’s responsibility
  • A restocking fee may apply

Faulty or Incorrect Items

If you receive a faulty, damaged, or incorrect item, you must contact us within 7 days of delivery.

We may request photographs or additional information to assess the claim.


9. Inspection Before Installation (Critical)

Bathroom, kitchen, and laundry fittings and fixtures (including but not limited to tapware, toilets, basins, vanities, sinks, baths, and tiles) must be thoroughly inspected prior to installation.

You and/or your installer must confirm:

  • The product is correct
  • The finish and colour are satisfactory
  • There are no visible defects or damage
  • The product is suitable for the intended application

Installation of any product constitutes full acceptance of the item.

Claims for visible defects, damage, colour variation, or incorrect items must be made before installation.

We are not responsible for:

  • Installation costs
  • Removal costs
  • Reinstallation costs
  • Plumber, builder, tiler, or trade call-out fees

Exceptions apply only where a fault was not reasonably detectable prior to installation.


 

10. Installer Responsibility

It is the responsibility of the customer and/or installer to ensure:

  • Products comply with applicable Australian or New Zealand standards
  • Installation follows manufacturer instructions
  • Products are suitable for the intended application

We are not liable for defects, damage, or failures arising from:

  • Incorrect installation
  • Misuse
  • Modification
  • Failure to follow manufacturer guidelines

Any advice provided by us is general in nature and does not replace professional installer judgment.


11. Promotions & Discount Codes

Discount codes must be applied at checkout.

They cannot be applied retrospectively.

Unless stated otherwise, promotions cannot be combined and are non-transferable.

We reserve the right to modify or withdraw promotions at any time.


12. Intellectual Property

All content on this Website — including text, images, logos, graphics and designs — is owned by or licensed to Art Bathrooms and protected by intellectual property laws.

You must not reproduce or use any content without written permission.


13. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential loss.
  • Our liability is limited to the amount paid for the relevant product.

Nothing in these Terms excludes or limits rights that cannot be excluded under Australian or New Zealand consumer laws.


14. Indemnity

You agree to indemnify us against claims, losses, damages, or expenses arising from your breach of these Terms or misuse of the Website.


15. Privacy

Your use of this Website is also governed by our Privacy Policy.


16. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Nothing in these Terms limits or excludes any rights available under applicable Australian or New Zealand consumer protection laws.

You submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.


17. Changes to These Terms

We may update these Terms from time to time.

The updated version will be published on the Website and applies from the date of publication.
